This article highlights the SPC's new judicial interpretations on antitrust disputes. By丨Frank Jiang, John Jiang Jason Jia, Jingshuang Ma, Xiaotong Zhou On June 24, 2024, the second anniversary of the promulgation of the newly-amended Anti-Monopoly Law of the People’s Republic of China ( “Amended AML” ), the Chinese Supreme People’s Court ( “SPC” ) promulgated the Interpretation of the Supreme People’s Court on Several Issues Concerning the Application of Law in Adjudicating Monopoly-related Civil Cases ( “New Antitrust JIs” ). The New Antitrust JIs became effective as of July 1, 2024 and superseded the Provisions on Several Issues Concerning the Application of Law in the Trial of Civil Dispute Cases Arising from Monopolistic Conduct ( “Old Antitrust JIs” ) promulgated by the SPC in 2012 and revised in 2020.
